A Fairfax County supervisor in Virginia is calling for the removal of sanctuary county policies for illegal immigrants, as the sheriff refuses to honor ICE detainers. Sheriff Stacey Kincaid stated that she will protect the rights of all individuals, regardless of immigration status, citing legal reasons for her decision.

Supervisor Pat Herrity criticized Kincaid’s stance, noting that other sheriffs in neighboring counties honor ICE detainers to keep their communities safe from repeat violent offenders. He expressed concerns about releasing violent criminals back into the community due to various policies and decisions made by officials.

Fairfax County Commonwealth’s Attorney Steve Descano has also stated that his office will not work with ICE on civil immigration enforcement, focusing instead on community safety and equal protection under the law.

The Trust Policy passed by the Fairfax County Board of Supervisors in 2021 prohibits the police from alerting ICE when an undocumented immigrant is arrested. Herrity, who opposed this policy, is advocating for its removal to give law enforcement agencies the ability to effectively address violent crimes in the community.

In the past year, the Fairfax County Sheriff’s Office had 725 undocumented immigrants in jail, with only three being transferred to ICE. The ongoing debate between county officials and law enforcement agencies highlights the complexities of immigration enforcement in the area.
