While some support changing the law to accommodate businesses struggling to meet the ratio, others argue that restaurants have already invested in the current system and that new competitors could gain an unfair advantage.
Public safety concerns and ongoing legal challenges also play a role in the debate around the food-to-beverage ratio law. Delegate Josh Thomas suggested a gradual reduction over several years to allow businesses time to adjust. However, with a lawsuit underway against the law, lawmakers are hesitant to make changes in 2025.
