VDOE now aligns with federal special education law


The Virginia Department of Education has successfully addressed issues related to the Individuals with Disabilities Education Act (IDEA) and is now back in compliance with the federal law after several years of being out of compliance. The U.S. Department of Education’s Office of Special Education Programs recently closed out the state’s monitoring, commending Virginia for its efforts to ensure that students with disabilities receive a free and appropriate public education.

The federal Education Department initially raised concerns about Virginia’s oversight of special education complaints and lack of procedures in responding to and monitoring complaints related to special education programs. After threats of withholding federal funding, Virginia made significant improvements under Governor Glenn Youngkin’s administration, ultimately earning a “meets requirements” designation, the highest rating for improving outcomes for students with disabilities and compliance with IDEA.

State Superintendent Lisa Coons expressed satisfaction with the progress made, stating that the Department has strengthened its commitment to providing supports and services for all children, families, and educators in Virginia. The Office of Special Education Programs praised Virginia’s efforts to improve implementation of IDEA and develop a supervision system that ensures compliance and better results for students with disabilities.

The successful resolution of these issues marks a significant achievement for the Virginia Department of Education and sets a positive example for other states to follow in serving children with disabilities throughout the Commonwealth.
