Virginia Consumers Await Action on Junk Fee Legislation
RICHMOND — Virginia consumers may soon be free from costly hidden fees, pending the governor’s approval of bipartisan legislation designed to enhance pricing transparency. The bills, which have passed both the House and Senate, aim to revise the Virginia Consumer Protection Act, mandating businesses to disclose the total price of services and products upfront. These legislative measures seek to eliminate the last-minute surcharges that often surprise consumers during checkout.
Though the General Assembly has passed the bills, they are currently stalled at the governor’s office. Governor Glenn Youngkin has returned the legislation with a request for a reenactment clause that would delay implementation until 2026, requiring the bills to go through the legislative process again next year. With all 100 seats in the House facing an election, the political landscape could potentially shift the outcome of the bills.
Youngkin also suggested including health clubs among businesses exempt from the fee disclosure requirements. Despite some bipartisan support, lawmakers have rejected these changes, leaving Youngkin until May 2 to act, including the option to veto.
Senator Stella Pekarsky, who introduced one of the bills, emphasized the importance of clear and understandable legislation, which has been modeled after successful laws in other states. Consumer advocates highlight that the average household reportedly spends around $650 annually on junk fees across various industries, from airlines to food delivery.
Ryan O’Toole of Freedom Virginia stressed that these hidden fees inflate costs without adding value, urging lawmakers to prioritize consumers’ financial well-being. Rhena Hicks echoed the need for transparency, asserting that Virginians deserve upfront pricing to build trust. Critics argue that Youngkin’s proposed changes merely serve to delay necessary consumer protections. The governor’s decision approaches swiftly, with a deadline looming on May 2.
