Virginia’s Clean Slate Law Set to Transform Lives in 2026
RICHMOND — A new "clean slate" law in Virginia, effective July 1, 2026, aims to offer a fresh start for individuals with qualifying past misdemeanors and felonies. Advocates argue this legislation is crucial for those whose past convictions hinder their opportunities long after they have served their sentences.
The law allows certain crimes to be sealed after a waiting period—seven years for misdemeanors and ten for felonies—provided the individual has not reoffended. Democratic State Senator Scott Surovell highlighted the significant demand, stating he has a list of constituents eager to have their records sealed, including one client with a petty larceny conviction that has impacted his life for over 30 years.
Preparation for the impending demand has begun, as the legislation necessitates significant updates to Virginia’s criminal record-keeping systems. The development process, already delayed for years and requiring $20 million in funding, is crucial to ensuring that the legal system can handle the expected influx of petitions. Challenges remain; while some offenses will be sealed automatically, most individuals will need to file petitions, creating additional burdens for an already stretched legal system.
Christa Gantz of the Virginia State Bar stressed the need for low-cost legal services, as many qualifying individuals may struggle to navigate the application process without assistance. Legal experts anticipate that over 100,000 Virginians could qualify for relief under the new law.
In preparation, the General Assembly has authorized additional staff for clerks’ offices to manage the increased workload. As the 2026 launch date approaches, community resources and pro bono efforts will be vital in ensuring that those affected can take full advantage of this transformative opportunity.
